How secure is my information?
All of your data (preferences, conversations) is stored securely and privately within industry-leading open source backend database ‘Supabase’. No one has access to your data except you. Supabase exercises exhaustive security protocols, including SOC2 Type 2 compliance, HIPAA compliance, AES-256 encryption, and DDoS protection.
Is my voice data secure?
Firstly, using your device’s dictation feature is optional. While this does enhance the learning experience, you are not required to ‘speak’ your responses to fully enjoy the app - Embraven™ was built on the assumption that most users would ‘text’ their responses. If you choose to use the speaking feature, all speech-to-text dictation is processed locally onboard your device, according to your device’s dictation Terms of Service (Apple or Samsung, etc) - Embraven™ never receives any voice data. The transcribed text is then sent to our servers in order to continue the conversation with the AI.

(b) Chat Logs: All interactions with Artificial Intelligence ("AI") characters are logged to facilitate conversations within the app. These logs are essential for the app’s operation; and
(c) Feedback: Any feedback submitted by users to help improve the app or for customer support purposes.2. How We Use Your Information
We use the collected information for the following purposes:(a) Customization and User Experience: Your basic information is used to tailor in-app conversations and enhance your experience;
(b) Core Functionality: Chat logs are critical to enabling conversations with AI characters and ensuring the app works as intended; and
(c) App Improvement: Any feedback you provide is used to improve features, develop new ones, and provide customer support.3. Data Sharing
We share your personal data with the following third-party service providers to ensure the proper functionality of our app:(a) Backend Database: Basic information and chat logs are stored in our third-party database to maintain user profiles and facilitate conversations; and
(b) OpenAI: Basic information and chat logs are shared with OpenAI to customize conversations with ChatGPT and enrich your learning experience.We do not sell your personal data to advertisers or any third parties.4. Data Security
We take data security seriously and have implemented the following measures:(a) Encryption: Our third-party Backend Database encrypts all data at rest using AES-256 and in transit using TLS, ensuring that your information is secure;
(b) Row-Level Security (RLS): We use RLS to ensure that only you, not other users, can access your data; and
(c) Additional Security Measures: We utilize multi-factor authentication (MFA) and regular security audits to protect against unauthorized access.While we leverage third-party services like our backend database and OpenAI, these services have their own privacy policies and security measures that we rely on.5. Apps made available through the App Store are licensed, not sold, to You. Your license to Embraven™ is subject to your prior acceptance of Embraven's EULA. Your license to Embraven™ is granted by Apple. Ryan Sobolski reserves all rights in and to the Licensed Application not expressly granted to you under this EULA.You acknowledge that this EULA is concluded solely between You and Embraven™, and not with Apple Inc. ("Apple"). Embraven™ is solely responsible for the Licensed Application and its content. Apple has no obligation to provide any maintenance, support services, or address any claims relating to the App.Your use of Embraven™ must comply with the App Store Terms of Service. You may not distribute or make the Licensed Application available over a network where it could be used by multiple devices at the same time. You may not copy, reverse-engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of Embraven™, any updates, or any part thereof.3. App Usage
You are required to register an account to access Embraven™. By using the App, You agree to engage in civil, ethical, and respectful interactions during conversations with the Artificial Intelligence ("AI"). Inappropriate language or behavior, including but not limited to violence, threats, harassment, abuse, or sexual inference, is strictly prohibited.Embraven™ reserves the right to terminate or delete any user account immediately and without notice if any of these behaviors are detected. Furthermore, You may be permanently banned from future use of the App.4. User Responsibilities
You agree to use the App responsibly. Any attempt to hack, reverse-engineer, or otherwise misuse the App’s AI or features is prohibited. You are solely responsible for the accuracy and legality of your conduct within the App.5. Subscriptions or In-App Purchases
Embraven™ operates on a subscription basis. You must pay a subscription fee to access the App. A single monthly payment for Embraven™ Premium Monthly provides access for one month from the date of payment. A single yearly payment for Embraven™ Premium Yearly provides access for 12 months from the date of payment.No refunds or cancellations will be provided once a payment is made. Continued access to the App is contingent upon the timely payment of the subscription fee.6. Acknowledgment of Originality
All characters and content within this App are the original creations of Ryan Sobolski and are intended solely for entertainment purposes. Any resemblance or similarity to any real persons, living or deceased, or to any fictional characters or entities, is purely coincidental and unintentional.By accessing or using this App, You acknowledge and agree that:(a) the interactive characters and content are entirely original and are not based on any real or fictional individuals; and
(b) any perceived similarities are coincidental and not intended to represent or portray any real or fictional individuals.7. External Services

(c) claims arising under consumer protection, privacy, or similar legislation.12. Limitation of Liability
Embraven™ is provided "as is," and to the fullest extent permitted by law, we make no warranties, whether express or implied, regarding the performance or availability of the App.You understand and agree that Ryan Sobolski will not be liable for any damages you may suffer in connection with your use of the App, including but not limited to technical issues, data loss, inaccuracies in conversations with the AI, or any other use of the App. Your use of the App is at your own risk, and Ryan Sobolski disclaims all liability for damages of any kind, whether direct, indirect, incidental, or consequential, arising from the use of the App.Under no circumstances shall Embraven™ be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to loss of profits, loss of data, business interruption, goodwill, use, data, or other intangible losses, arising out of or related to:(a) your use or inability to use the App, however caused, regardless of the theory of liability (contract, tort, or otherwise) and even if Ryan Sobolski has been advised of the possibility of such damages;

We reserve the right to suspend or terminate Your account at any time, without notice, for any breach of this EULA or for inactivity lasting longer than six months.If You wish to terminate your account, You may do so by navigating to the Settings page within the App, selecting the "Delete my account" option, and confirming the permanent deletion of Your account.15. Intellectual Property
All intellectual property rights, including but not limited to content, characters, branding, and technology used in Embraven™, are proprietary and protected under applicable intellectual property laws and treaties. You are granted a limited, non-transferable, and non-exclusive license to use the App for personal purposes only.You are strictly prohibited from using the App’s content for commercial purposes, self-promotion, defamation, or any other unauthorized activities. Any breach of this clause may result in legal action.Apple is not responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim.16. Legal Compliance
You represent and warrant that (i) You are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) You are not listed on any U.S. Government list of prohibited or restricted parties.You may not use or otherwise export or re-export Embraven™ except as authorized by United States law and the laws of the jurisdiction in which the Licensed Application was obtained. In particular, but without limitation, Embraven™ may not be exported or re-exported (a) into any U.S.-embargoed countries or (b) to anyone on the U.S. Treasury Department's Specially Designated Nationals List or the U.S. Department of Commerce Denied Persons List or Entity List. By using Embraven™, You represent and warrant that You are not located in any such country or on any such list. You also agree that You will not use these products for any purposes prohibited by United States law, including, without limitation, the development, design, manufacture, or production of nuclear, missile, or chemical or biological weapons.17. Governing Law and Dispute Resolution
Except to the extent expressly provided in the following paragraphs, the relationship solely between You and Apple shall be governed by the laws of the State of California, excluding its conflicts of law provisions. You and Apple agree to submit to the personal and exclusive jurisdiction of the courts located within the county of Santa Clara, California, to resolve any dispute or claim arising from this Agreement. (a) You are not a U.S. citizen;
(b) You do not reside in the U.S.;
(c) You are not accessing the Service from the U.S.; and

Any legal disputes arising from this EULA or Your use of the App must first be resolved through mediation before pursuing legal action.Embraven™ is not responsible for legal proceedings initiated by You, and all efforts must be made to resolve disputes amicably through mediation before litigation. This clause is designed to ensure that You approach any dispute resolution in good faith.Specifically excluded from application to this Agreement is that law known as the United Nations Convention on the International Sale of Goods.18. Third Party Beneficiary
You and Embraven™ acknowledge and agree that Apple, and Apple’s subsidiaries, are third party beneficiaries of this EULA, and that, upon Your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against You as a third party beneficiary thereof.19. Severability
